1. Acceptance of Terms
By accessing, browsing, or using this website (the "Site"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately cease using the Site. Your continued use of the Site after any modification to these Terms constitutes acceptance of the modified Terms.
BY CLICKING "I AGREE," CREATING AN ACCOUNT, SUBMITTING AN APPLICATION, OR OTHERWISE USING THIS SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT, A WAIVER OF YOUR RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, AND A WAIVER OF YOUR RIGHT TO BE THE BASIS OF AN ASSOCIATIONAL STANDING LAWSUIT, AS SET FORTH IN SECTION 8.
2. Description of the Site
The Site is operated by Return to the Land Foundation (the "Foundation"), a program of Community Advocacy Group, Inc., a Tennessee nonprofit public benefit corporation organized under Section 501(c)(4) of the Internal Revenue Code as a social welfare organization. The Site provides general information about the Foundation and its programs. Certain features and content are available only to participants in the Foundation's programs.
The Foundation is a social welfare organization. Contributions to the Foundation may not be deductible as charitable contributions for federal or state income tax purposes.
3. Privacy
The Foundation respects the privacy of its Site visitors. Information collected through the Site will be used solely for the purposes of administering the Foundation and its programs. The Foundation will not sell, rent, or share personal information with third parties except as required by law or as necessary to administer the Foundation's programs and benefits.
4. Intellectual Property
All content on the Site, including text, graphics, logos, and other materials, is the property of the Foundation or its licensors or licensees and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Site without the prior written consent of the Foundation.
5. User Conduct
You agree not to use the Site to:
- Violate any applicable law or regulation;
- Collect or harvest personal information about other users;
- Interfere with or disrupt the Site or its servers;
- Attempt to gain unauthorized access to any portion of the Site;
- Use the Site for any purpose that is fraudulent, deceptive, or harmful to the Foundation or its programs.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FOUNDATION, ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, INCLUDING ANY REFERRAL TO A THIRD-PARTY ORGANIZATION, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF THE FOUNDATION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE FOUNDATION'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
7. Disclaimer of Warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE FOUNDATION DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8. Dispute Resolution, Arbitration, and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.
- Informal Resolution. Before initiating any formal dispute resolution proceeding, you agree to first contact the Foundation to attempt to resolve the dispute informally for a period of at least sixty (60) days.
- Binding Arbitration. If the dispute cannot be resolved informally, any claim, dispute, or controversy arising out of or relating to these Terms, the Site, or your relationship with the Foundation shall be resolved exclusively by binding arbitration administered under the rules of the American Arbitration Association. The arbitration shall take place in the State of Arkansas. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
- Class Action Waiver. YOU AGREE THAT ALL DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE THE RIGHT TO BRING, JOIN, OR PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING AGAINST THE FOUNDATION, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS. This waiver is a material term of the arbitration agreement in this Section; if a court or arbitrator of competent jurisdiction deems this waiver unenforceable, the entire arbitration agreement shall be void.
- Waiver of Associational Standing. By using this Site, you waive the right to authorize any third-party organization to assert claims against the Foundation, its directors, officers, employees, or agents on your behalf through associational standing or any similar legal theory. This waiver extends to any organization that would rely on your individual injury as the basis for standing to sue. This waiver does not affect your individual right to bring claims on your own behalf.
- Waiver of Jury Trial. YOU WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE.
9. Forum Selection
To the extent that any dispute is not subject to arbitration under Section 8, you agree that any legal action or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in the State of Arkansas, and you consent to the personal jurisdiction of such courts.
10. Indemnification
You agree to indemnify, defend, and hold harmless the Foundation, its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, including your dealings with any third-party organization referred through the Site, or your violation of these Terms.
11. Third-Party Referrals — Koryos Initiative
The Foundation operates the Koryos Initiative, a referral service that may introduce you to fraternal, civic, and community organizations. The Koryos Initiative is informational only.
The Foundation does not own, control, operate, manage, supervise, or endorse any organization to which it refers individuals. Inclusion on any referral list is not an endorsement, recommendation, or guarantee of any organization, and reflects only that the organization's stated mission aligns with the Foundation's social welfare purposes.
The Foundation is not a party to any relationship between you and a referred organization. Each referred organization is independent and maintains its own membership criteria, vetting, dues, rules, and application process. A referral does not guarantee acceptance into any organization.
The Foundation makes no warranties regarding any referred organization, including its legitimacy, safety, financial condition, or conduct, and is not responsible or liable for any acts, omissions, disputes, dues, fees, injuries, or losses arising out of or relating to your dealings with a referred organization. You are solely responsible for evaluating any organization before joining it or paying any amount to it.
12. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The parties agree to replace any invalid or unenforceable provision with a valid and enforceable provision that achieves, to the extent possible, the original intent.
13. Entire Agreement
These Terms constitute the entire agreement between you and the Foundation with respect to your use of the Site and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and the Foundation with respect to the Site.
14. Modifications
The Foundation reserves the right to modify these Terms at any time. Any modifications will be effective upon posting on the Site. Your continued use of the Site after any modification constitutes acceptance of the modified Terms.
